FUTURE FIGHT STARZ, WHO YOU WITH

RELEASE AND WAIVER OF LIABILITY

1. Important Notice

PLEASE READ THIS WAIVER CAREFULLY.
This document affects your legal rights if you are injured, become ill, or suffer any damages while participating in Future Fight Starz, Who You With Promotions ("WYW") activities. These activities include, but are not limited to:

• Brazilian Jiu-Jitsu (BJJ)

• Grappling

• Submission Wrestling

• Mixed Martial Arts (MMA)

• Full-contact sparring

• Tournaments

• Travel related to any WYW event

By signing this document, you acknowledge and accept the risks associated with participation in these activities.

 

2. Acknowledgment of Risks & Release of Liability

A. Assumption of Risk
WYW events involve intense physical contact and pose inherent risks of severe injury or death. The undersigned participant (hereafter "Participant"), including a parent or guardian if the Participant is a minor, acknowledges and voluntarily assumes all risks associated with these activities.

B. Release of Liability
Participant hereby agrees to release, waive, discharge, hold harmless, and covenant not to sue Future Fight Starz, Who You With Promotions, its members, managers, officers, agents, independent contractors, and affiliates (collectively referred to as "Releasees") for any liability, loss, damage, claim, or cause of action arising out of participation in any WYW event.

This waiver applies regardless of whether the injury or damage is caused by:

• Participant’s negligence

• The negligence of the Releasees

• The negligence of any third party, including other participants

C. Indemnification Agreement
Participant agrees to indemnify and hold harmless the Releasees from any claims brought by third parties related to the Participant’s presence or participation in a WYW event.

D. Binding Effect
This waiver is binding upon:

• The Participant’s family members

• Legal guardians

• Spouse (if applicable)

• Heirs, assigns, and personal representatives (if the Participant is deceased)

Participant further agrees that this Release and Waiver of Liability shall be governed by the laws of the State of California and shall apply to both known and unknown claims.

3. COVID-19 & Infectious Disease Waiver

A. Assumption of Risk Related to COVID-19
Participant acknowledges the highly contagious nature of COVID-19 and other infectious diseases and voluntarily assumes the risk of exposure, infection, and potential serious health complications, including permanent disability or death.

B. Scope of COVID-19 Liability Release
Participant releases, waives, and covenants not to sue the Releasees for any claims, damages, or liabilities related to COVID-19 exposure, whether such exposure occurs before, during, or after the event and regardless of whether it was caused by:

• The actions or negligence of the Participant

• The actions or negligence of Releasees

• The actions or negligence of other attendees

Participant agrees to accept sole responsibility for any injuries, losses, or damages resulting from exposure to COVID-19.

4. Media & Image Rights Release

A. Grant of Media Rights
Participant grants Releasees exclusive rights to record, photograph, and use their likeness in any form of media, including but not limited to:

• Photographs

• Videos

• Digital or printed media

B. Ownership & Usage Rights
Participant acknowledges that all media content created during WYW events shall be the sole property of Releasees, including copyright ownership. Releasees have the unrestricted right to:

• Use, edit, modify, or republish the content

• Combine it with other media or textual content

• Utilize it for promotional, artistic, editorial, advertising, or any other purpose

C. Prohibition Against Unauthorized Use
Participant understands that any unauthorized use of WYW-related images or media is a violation of this agreement and may result in legal consequences for copyright infringement.

5. Final Acknowledgment & Voluntary Agreement

By signing this Release and Waiver of Liability, the Participant:

1. Confirms they have read and understood the terms of this document.

2. Agrees to be bound by all terms and conditions outlined above.

3. Acknowledges that they are signing voluntarily, without coercion or duress.
